Eric McDavid Update

Dear friends,

Yesterday was a difficult day. We all knew what Eric was facing, and we understood the vehemence with which the government was pursuing this case. But nothing could ever fully prepare us for the kind of heinous sentence that Eric received. It is clear from the reports in the media and the
statements made by the US Attorneys that Eric was entrapped and used as an example to anyone who dares to dream of how things could be different in this world.

After passing through the metal detectors downstairs, everyone attending Eric's sentencing was required, by order of Judge England, to pass through a line of Marshall's outside the courtroom and undergo the metal detector wand, as well as a complete search of any bags. This ridiculous spectacle was clearly an attempt to harass Eric's friends and loved ones who came to show their support.

The courtroom was nearly full of Eric's family and friends. There were not enough seats behind the defense table to accommodate everyone, forcing others to spill over into the prosecutor's side of the court. Thanks to everyone who came out on Thursday.

It was clear from the first few sentences spoken by the judge that his mind was already made up. The same lies that were used at trial to convict Eric were repeated over and over again throughout the sentencing hearing. The government even had the audacity to claim that Eric had never had a re-ocurrance of pericarditis - despite the fact that his lawyer filed a memo with the court in November detailing Eric's worsening condition. Despite the fact that the jail received so many phone calls from Eric's supporters during that time that they posted a note on their website specifically asking people to stop calling. They had the audacity to claim that Eric was at no risk of harsh treatment in prison - despite the fact that he has ALREADY undergone 2 1/2 years of isolation at the Sacramento County Main Jail.

Despite the fact that probation recommended a sentence of 156 months (13 years), Judge England deferred (as usual) to the government's recommendation of 235 months (19 years and 7 months). The length of Eric's sentence was due largely to the application of the Terrorism Enhancement. The government has argued quite vociferously all along for this enhancement. The basis of their argument is that Eric's targets included government facilities (such as the IFG) - a point which was never proven during trial, and was, in fact, denied by the government's own witnesses. But the judge applied the enhancement anyway. The judge ordered 3 years of supervised release after Eric's sentenced is served, the collection of a DNA sample and registration as an "arson offender".

Now is the time to be outraged and make noise. The government just sentenced Eric to 20 years for a crime that was never committed. This is the longest sentence we have heard of in an American environmental case. Eric's case and sentence illustrate the lengths the government goes
to , and how much they can get away with, in their pursuit of those who voice their dissent - who maintain their integrity and stay true to their principles and all that makes them human. Please help spread the word about Eric, his case, and it's implications for everyone who cares about effecting real change.

Eric could be moved any time in the next month or two to a federal facility, but please don't let that deter you from writing! We will let everyone know as soon as we get word that he is being moved. Until then, keep the letters coming.

Eric will now be appealing his conviction. Unfortunately, this can be a very long process. Please don't forget about Eric during this time. He will continue needing your support throughout his time in prison. When he reaches a federal facility we will send out a statement about his support needs at that time.

Eric didn't have a fair trial and the tactics used by the government to get the arrests were borderline illegal and definitely coercive. Read up on the case. But I doubt that would change your outlook. You sound like a conservative or maybe even a libertarian. Whatever you identify is it doesn't matter. You troll around DC IMC to dump out negative, divisive and unhelpful comments. It's like a sport for you people. DC IMC is a place where things like this article will get posted, where radical news, information, announcements and analysis is posted. You people have the whole of the mainstream media, countless blogs and web sites to troll around on and share thoughts on the things you agree on and want to work on. Stop degrading the IMC and the intent of this space and move on. You comment was originally deleted because it doesn't have a place on the IMC. You only want to have yet another place in this world where you can sound off and validate your self. Well bag off! You're not welcome!

The case of Eric McDavid raises a lot of important issues for the radical left as well as anyone doing work on the left that directly protests the government. Harassment of activists is up. As the vein of fascism in the is country grows stronger this type of thing will only happen more often. The state isn't fucking around and neither should we. If you are engaged in activism you need to be talking with your friends and colleagues about your legal support should anything happen, you need to think about harassment by law enforcement and what they could use against you no matter how absurd before planning anything. Don't stop planning, don't stop working, don't stop challenging, don't stop talking to each other; but let's start being prepared. Let's start taking seriously the intent of the state to pick us off one by one and tare us apart.

Please. People on the radical left have been clamoring about "fascism" since the 1960s, if not earlier. The U.S. has plenty of room for improvement but to call this country fascist shows the extent of your political consciousness. It also is a slap in the face against people who have actually experienced totalitarianism.

I don't know but when people are arrested and thrown in prison for over 19 years for just thinking about taking action or people are in prison right now for running a website or when hundreds upon hundreds of cops are protecting neo-nazis when the come to D.C. while it citizens get arrested and pepper sprayed for opposing them or when hundreds of people are locked up in Cuba for being Muslim looking and not even given a damn lawyer and are treated like guilty people when they haven't been proven guilty in a court of law, that smells like fascism. Nay it reeks of fascism sure it is not as bad as lets say nazi Germany or Stalin's Russia but it is pretty bad! People are getting deported and raided for little more than working hard for shit pay or just being activists, it doesn't sound like any sort of democracy to me, but who needs democracy when a nice little fascist leaning oligarchy is way easier for those in charge!

No, people are being deported because they are in the country illegally. There are also concerns about identity theft. If you did the same thing in another democratic country you could face deportation as well. Try working illegally in the U.K. or France as a U.S. citizen, for example. See how "fascist" they treat you.

BTW, in a real fascist regime revolutionary anarchists, communists, and others dedicated to overthrowing the government would not be able to print their newspapers, run their infoshops, IMCs, etc. etc. etc.

No a democratic country wouldn't deport people democracy is not about putting up borders and keeping people out it is about everyone participating and being treated equally it is rule of the demos (the people) If you read what was written I didn't call it fascism I called it a fascist leaning oligarchy. People are being deported for working hard for shit pay...you don't here about the government trying to go after MS-13 or trying to deport racists who are here illegally but those who work hard for shit pay and those who are families and besides what is being here illegally when your ancestors lived on this land before the U.S. borders were set up or before the U.S. even existed!

You may not. But to those of us who actually read, the information is out there and available. The FBI, police, and other law enforcement agencies have made numerous arrests and deportations of MS-13 members.

I supported the deportations but the results have been less than stellar:

And, yes, democratic countries deport people. In fact, all of the democratic countries deport people.

Democracy is not about borders? Democratic countries need to control their borders just like every other country.

If you want to examine an oligarchy, look at Russia or spend some time over there. Check out Saudi Arabia.

Look, I realize you and most of the people involved with the IMCs hate the U.S. government but simply claiming something over and over does not make it so.

Oh real fair and unbiased! AN ARMED TERRORIST GETS OFF FREE, but a GUY WHO DID NOTHING IS GOING TO PRISON FOR 19 YEARS? What the fuck kind of justice is that Tyler Froatz has a history of being out of line then he actually goes and and assaults someone at a rally with a whole arsenal of weapons on him and a bunch more at his house and a handrawn map of exits to the park where he assaulted someone (that were an idea hatched by racist internet radio loonie Hal Turner who has a relationship with Sean Hannity, but that is separate issue) and he has a racist brother as well and his parents probably aren't all that sure footed if they raised racist terrorists one of which actually was about to act on his inner feelings and no doubt could be the next person to shoot up a mall or a school or other public place but Eric Mc David thinks about maybe doing something or has some beliefs that the government doesn't like and he gets 19 years? Sorry but your scales are clearly tipped...murderers and domestic terrorists are getting off without even at least 5 years in prison and someone has some beliefs that the supposed "democratic" government doesn't like and he gets 19+ and others around him get around the same, some for just running a website others for ruining a few SUVs which didn't hurt a single person or assault anyone (keeping in mind those vehicles are going to hurt people with all of the toxic smog that goes into our childrens schools and our hospitals and everywhere else we breath) Heck there are people in Gitmo who still haven't seen a lawyer and whether guilty of anything or not they haven't even gotten one of your sham trials of justus and therefore should be free and if they actually have a TRUELY FAIR AND UNBIASED TRIAL and are found guilty of an actual real crime (not thinking or running a website) then you can lock them up but you are supposed to be innocent until proven guilty and because someone looks a certain way doesn't not prove guilt especially if there is no crime to commit them for. This is the same shit they did back in World War Two to the Japanese but of course those families must have been all evil terrorist spies because they have a certain skin color or believe in certain things or are from a certain country...

Lock up everyone but you...that seems like it might be fair and unbiased in your eyes.

Your rants are very difficult to read when they are completely lacking in commas and periods. I suppose this is as good a reason as any not to read them in the first place.
